Battles against domestic violence in the People’s Republic of China have been carried out since 1995. In this study, legislative progression of laws related to domestic violence is first examined and clarified; second, findings from the legislative review are investigated on the basis of civil and criminal cases; third, the interaction among social and traditional norms, legislation, and judicial outcomes is explored and interpreted from a sociosemiotic perspective. It is found in this study that: 1) legislation and judicial practices of (...) domestic violence in the P. R. C. are closely intertwined with social and traditional norms; 2) there is a gap between judicial practices dealing with domestic violence and the legislation; 3) the Anti-Domestic Violence Law offers a notch for state powers to embrace the familial relationship and to safeguard a victim. BackgroundAging and type 2 diabetes mellitus are important risk factors for the development of cognitive deterioration and dementia. The objective of this research was to investigate the effects of an exercise intervention on cognitive function in older T2DM patients.MethodsEight literature databases were searched from inception to 20 January 2022. The researchers examined randomized controlled trials that evaluated the impact of exercise on the cognitive performance of older T2DM patients. The Cochrane risk-of-bias tool for RCTs was used to assess each study. (...) The quality of evidence was assessed using the GRADE approach. The mini-mental state examination, Modified MMSE, and Montreal cognitive assessment were used to evaluate the cognitive outcomes. We performed a subgroup analysis with stratification according to exercise intervention modality, duration, and cognitive impairment.ResultsFive trials were eligible, with a total of 738 T2DM patients. The combined findings revealed that exercise improved global cognitive function significantly. In the studies that were included, no relevant adverse events were reported.ConclusionExercise is beneficial in improving global cognitive function in older adults with T2DM. Before and during the times of Confucius and Aristotle, the concept of friendship had very different implications. This paper compares Confucius’ with Aristotle’s thoughts on friendship from two perspectives: xin 信 and le 乐. The Analects emphasizes the xin as the basis of friendship. Aristotle holds that there are three kinds of friends and corresponding to them are three types of friendship. In the friendship for the sake of pleasure, there is no xin; in the legal form of friendship for (...) the sake of utility, xin is guaranteed by law; and in the moral form of friendship for the sake of utility, xin is guaranteed by morality; in the friendship for the sake of virtue, xin is an indispensable part. Both thinkers believe friends can bring joy to human life. According to Confucius, it is the joy of rendao 仁道, whereas for Aristotle, it is the joy of Reason. There are many commonalities and differences between the two. The commonalities reveal some inner links between Confucian rendao and Aristotelian Reason. It seems that the differences between rendao and Reason are the differences between moral reason and logical reason. The comparative study is helpful for us to understand the two masters’ ethics, politics and philosophy. (shrink)

Genre has been a critical issue in discourse analysis as well as in other disciplines. Based on a literature review of the concept of genre and taking judgments as one type of genre in legal settings, the present study provides a corpus-based insight into the nature of genre. The literature review per se reveals that genre has one typical feature of a sign, that is, being subject to multiple and alternative interpretations; in other words, genre as a sign may have (...) various interpretants. The present study unravels the actual generic structures, distinguishes different types of generic structures within the given genre, and then defines the dominant generic structure of judgments in Hong Kong, Taiwan, and Mainland China. This study also examines and contrasts the generic structure potential of judgments in each jurisdiction. In addition, the variation of Mainland China's judgments over time is briefly discussed. Comparing the generic structures of judgments among the three jurisdictions, as well as the structures of judgments in Mainland China over time, the paper argues that genre also has the essential features of a sign, that is, the characteristics of temporality and spatiality. The erosion of the three interlocking dimensions of nature, society and self is the consequence of what Felix Guattari referred to as integrated world capitalism (IWC). In South Africa the erosion of nature, society and self is also the consequence of centuries of colonialism and decades of apartheid. In this paper I wish to explore how the African philosophy of ubuntu (humanness), which appears to be anthropocentric, might be invoked to contribute to the healing of the three ecologies—how healing of (...) the social might transversally effect healing of nature and the self. My theoretical exploration has relevance to education in South Africa, given that a mandate of national curriculum policy is that indigenous knowledge systems form part of the discursive terrains of all school learning areas/subjects. Drawing upon conservation of resources theory, we develop and test a theoretical model that specifies how and when employee humor toward leaders affects leader abusive supervision. We propose that employee humor is negatively associated with leader abusive supervision via leader relational energy. Furthermore, the negative indirect relationship between employee humor and leader abusive supervision via leader relational energy is stronger for female leaders than for male leaders. An experiment and a multi-wave, multi-source field study provide substantial support for our hypotheses. (...) Elgin has argued that scientific models that are, strictly speaking, inaccurate representations of the world, are epistemically valuable because the “falsehoods” they contain are “felicitous”. Many, including Elgin herself, have interpreted this claim as offering an alternative to scientific realism and “veritism”. In this paper, I will argue that there is a more felicitous interpretation of Elgin’s work: “felicitous falsehoods” do play a role in the epistemic value of inaccurate models, but that role is of instrumental value. Elgin’s view is (...) not best understood as claiming that falsehoods provide scientific understanding in and of themselves, only that they facilitate epistemic access to the fundamental, even if partial, truths that are contained within models. While falsehoods may be felicitous in that they facilitate exemplification, the epistemic value of inaccurate models ultimately relies on their partial accuracy. (shrink)

A hitherto unexamined problem for the ‘‘Kantian ideal’’ that one should always treat patients as ends in themselves, and never only as a means to other ends, is explored in this paper. The problem consists of a prima facie conflict between this Kantian ideal and the reality of medical practice. This conflict arises because, at least presently, medical practitioners can only acquire certain skills and abilities by practising on live, human patients, and given the inevitability and ubiquity of learning curves, (...) this learning requires some patients to be treated only as a means to this end. A number of ways of attempting to establish the compatibility of the Kantian Ideal with the reality of medical practice are considered. Each attempt is found to be unsuccessful. Accordingly, until a way is found to reconcile them, we conclude that the Kantian ideal is inconsistent with the reality of medical practice. (shrink)

En amont des représentations collectives et des formes instituées de la vie sociale, cet article se propose d’étudier l’articulation de l’intersubjectivité et de l’incarnation dans la constitution du soi et de l’autre comme une genèse phénoménologique de la reconnaissance à travers la lecture ricoeurienne de la cinquième des Méditations cartésiennes publiée dans À l’école de la phénoménologie. Lors de la donation du sens ego dans l’intersubjectivité, la constitution de la reconnaissance sur le plan de la perception se fait grâce aux (...) distinctions entre corps (Körper) et chair (Leib) d’une part, et, d’autre part entre chair (Leib) et corps propre (Leibkörper). L’analyse des textes sur "Le sentiment,” repris dans À l’école de la phénoménologie, et sur "La fragilité affective" dans L’homme faillible, propose une phénoménologie de la reconnaissance sur le plan de l’affection. The phenomenon of knowledge withholding is a vital issue that undermines knowledge sharing and innovation, hinders the development of offline and online organizations. Clarifying the relationship between influencing factors and knowledge withholding is significant to improve the phenomenon of knowledge withholding in offline and online organizations. Few types of research focus on the online virtual academic community and integrate the three factors of knowledge, individual, and environment to research knowledge withholding. To solve the limitation, this research is based on sociology (...) and psychology-related theories. The two dimensions of enabling and inhibition are divided into factors affecting knowledge withholding. An attempt is made to explore the path between the three types of factors influencing knowledge, individual and environment, and knowledge withholding. This study collected data from 616 users in China’s virtual academic community. It used a structural equation model combined with a cross-layer connected neural network to conduct an empirical analysis on the proposed hypothesis. The results found that: in the virtual academic community, knowledge power in the enabling dimension is the main reason for users to form knowledge psychological ownership, which affects users’ knowledge withholding. However, the effect of professional commitment on users’ knowledge psychological ownership is not significant. After SEM-ANN model fitting, the combined inhibitory effect of community privacy protection and community reciprocity on user knowledge withholding in the inhibition dimension is significantly improved. This research has a specific guiding significance for enhancing the knowledge withholding phenomenon of the virtual academic community and creating an excellent academic exchange atmosphere. (shrink)
